us”) and we are committed to protecting the privacy of your information in our control. This GasBuddy Privacy Policy (the “
Privacy Policy”) describes how we collect, use, store, share and protect your Personal Information. This Privacy Policy applies to all Personal Information collected during any written, electronic, and oral communications, as well as any Personal Information we collect on the GasBuddy websites from which we link this Policy (the “
Sites”), and other services and tools (including, but not limited to, mobile applications and other software applications) that link to this Privacy Policy (collectively, the “
Services”).
What Personal Information We Collect
We collect personal information when you provide it to us, or when you use our Services or Mobile App. This may include information you provide to create your GasBuddy Account or in your communications with us, such as your name, username, email, phone number, profile picture, and vehicle information, and information you share with our services, such as your comments, reviews, reviews and ratings.
With your permission, we may collect your geolocation.
We may also collect technical information about your device and your use of our Services, such as the version of our app you use,
device id, device manufacturer and model, operating system name and version, screen resolution, battery optimization, page views, traffic to and from our Service, IP address, web log information, the permissions you have given us, and other technical data.
How We Use Personal Information
We use personal information to provide and improve our services, and to personalize, customize, measure, and improve advertising and marketing. We may contact you with promotional material, including by email, and this information may be personalized to your interests.
If you share your location, we may use it to help you locate gas stations and other retailers near you, locate offers near you, and we may share it with Foursquare to provide customized features, products, and content (including marketing/advertising content), and for analytics. You can always turn off location services.
We may also use personal information to protect ourselves or others, if required or permitted by law, or with your consent.
When We Share Personal Information
We may share personal information with service providers that help us process it as described in this Privacy Policy, and with our affiliates. We may share personal information to protect ourselves or others, if required or permitted by law, or with your consent. If you enable location sharing, we may share your location information with Foursquare to provide customized features, products, and content (including marketing/advertising content), and for analytics.
Your Privacy Rights
You have rights in respect of your personal information, including the right to withdraw your consent to its collection, use, and disclosure, to request access to is, and to ask us to correct it if it is inaccurate.

Terms of Service carefully before you use our Service. This Privacy Policy is governed by the terms and conditions in the GasBuddy Terms of Service.
By creating a GasBuddy account, or by otherwise accessing, visiting or using the Service, you expressly consent to the data practices described in this Privacy Policy. If you do not feel comfortable with any part of this Privacy Policy please discontinue your access or use of the Service immediately, or exercise those choices we describe in this Privacy Policy so that you are comfortable with the information processing we describe.
If you access the Service through another service that provides a gateway to the Service, such as iTunes or Google Play (a “
Gateway Service”), you will have a separate, additional account relationship with that Gateway Service. We have no control over or responsibility for the collection of information by a Gateway Service, and any such collection or use will be subject to Gateway Service’s applicable privacy policies.
We may modify this Privacy Policy from time to time. The most recent change will be indicated at the beginning of this Policy. If we make any material changes, we will notify you by email (sent to the email address specified in your account), by means of a notice on our Services prior to the change becoming effective, or as otherwise required by law. If you do not agree to the new terms, you may terminate your account by contacting us at

Personal Information is any information that we collect on or in connection with the Services that relates to you, identifies you personally or could be used to identity you, such as your name, email, phone number and address ("
Personal Information"). Aggregated or anonymized information does not constitute Personal Information. The types of Personal Information that we may collect about you are:
- Account Information. We may collect Personal Information that you provide to us when you use the Service, send email messages, forms, or other information to us, or enter a drawing, promotional contest, or giveaway offered through the Service. If you open a GasBuddy account directly through the Service, you may be required to provide your email address and create a user nickname and password, and we may assign you a GasBuddy Account ID number. You can use the Service without an account, however, you may not be able to use certain features of the Service.
- Information You Provide to Us.
- GasBuddy Account. You may also choose to provide additional Personal Information and other information in connection with your account, including your first and last name, username, email address, phone number, a profile picture, and your car make/model/year. Providing this additional information is optional and you are not required to provide this information in order to use the Service.
- Drawings, Promotional Contests & Giveaways. If you enter a drawing, contest, or giveaway offered through the Service you will be required to provide your postal address, including the street address, city, province, and postal code.
- Information You Share on the Service. Some portions of the Service allow you to submit comments, reviews, ratings and other content. This content may be displayed on the Service and may be seen by other users of the Service. In addition, if you have created a user profile and uploaded a photograph of yourself in connection with your GasBuddy account, other users of the Service will be able to see your user profile information and your photograph when you submit content to the Service while logged in to your GasBuddy account.
- Information Provided By Business Partners. We may receive information about you from other sources. For example, this may include receiving information from our business partners, including analytics vendors and advertising networks. This information may include your name, email address, phone number, full mailing address, and date of birth. We may combine information we receive from other sources with information that we collect directly through the Service. We may also combine information we collect about you from the different devices you use to access our Service.
- Geolocation Information. If you access the Service through a mobile device, allow location tracking in your device settings, and provide your consent for location tracking by the GasBuddy App, we will automatically collect information about your geolocation, including your geolocation relative to and within third-party merchant locations. You have the option to allow location tracking never, once, only when you are using the GasBuddy App, or at all times (including in the background if the App is closed). You can turn off location tracking whenever you want by changing your device or App settings. You may also choose to turn off "precise" location. If you do, the location information we receive will be more general. However, we cannot offer you some of the features of the Service, such as the "Find Gas Near Me" feature, if we cannot collect your geolocation information. If you do not want us to collect your geolocation information you may change your preferences through the "Settings" feature of the GasBuddy mobile application, or turn off the location setting on your mobile device. Please see GasBuddy’s Disclosure of Information to Third Parties section of this Policy to see how GasBuddy may share your location data, including your precise geolocation.
- Device Information. In addition, we may collect information such as your mobile device ID, device type, and your use of certain features or functions, on the device (for example, if you have enabled settings or features that interact with the Services, such as the location setting), as well as app version, device id, device manufacturer and model, operating system name and version, screen resolution, resolution width, resolution height, resolution density, battery optimization, the permissions you have given the Services, and similar technical data. We may collect this information even if you are not logged in to the Service. We may collect this information ourselves, or through third-party vendors. If you access the Service through a computer, we will automatically collect information such as your browser type and version, computer and connection information, statistics on page views, traffic to and from the Service, Internet Protocol ("IP") address and standard web log information. This device information is used to better display our app and website on your device, to identify and correct errors or bugs, and for authentication and analytics purposes. We also use OS (iOS or Android) for targeting Home Screen cards or first party ads. For information on how to opt-out of targeted advertising, see “Your Choices” below.
- Information Provided to Us by Social Networking Services You Use. By logging into the Service through a third-party social networking service, such as Facebook or Twitter, you give us permission to access, store and use any information that you permit the applicable third-party social networking service to share with us in accordance with the privacy settings that are applicable to your account with that social networking service. This information may include your name, email address, social media account user name.
We encourage you to review, and if necessary, adjust, your privacy settings on the applicable social networking service before logging in to the Service through a social networking service. Information that we receive from third-party social networking service is stored and used by us in accordance with this Privacy Policy.
In some cases, we or third parties may use cookies and similar technologies, such as pixel tags, that automatically collect information. Cookies are small files, typically of letters and numbers, downloaded onto your computer or mobile device when you visit certain websites. When you return to these websites, or visit other websites that use the same cookies, the websites recognize these cookies and your device.
Pixel tags are very small images or small pieces of data embedded in images, also known as "web beacons" or "clear GIFs", that can recognize cookies, the time and date a page is viewed, a description of the page where the pixel tag is placed, and similar information from your computer or device.
Information that may be collected by cookies when you use the Service may include, without limitation:
- the pages you visit within the Service;
- the date and time of your visit to the Service;
- the amount of time you spend using the Service;
- the IP address of your computer or mobile device; and/or
- computer and connection information such as browser type and version, operating system and platform.
Some of the functions performed by cookies are strictly necessary for us to be able to offer you our Service, while other cookies provide us with valuable insight about how we can improve our Service or help us with marketing our products and services to you based on your interests and preferences.
The length of time a cookie will stay on your browsing device depends on whether it is a "persistent" or "session" cookie. Session cookies will only stay on your device until you stop browsing (i.e. after you have finished browsing). Persistent cookies stay on your device until they expire or are deleted (i.e. once the period set on the cookie expires, or when you delete your cookie cache).
First and Third-Party Cookies
When you access our Services, we or companies we work with may place cookies on your computer or other device. These technologies help us better understand user behavior and inform us about which parts of our websites people have visited.
We use both first-party and third-party cookies on our Service. First-party cookies are cookies that are placed on your device by us, while third-party cookies are set by parties other than GasBuddy. Third-party cookies are operated by third parties that can recognize your device both when it visits our Service and when it visits other websites or mobile apps. GasBuddy does not control how third-party cookies are used, and we encourage you to check the websites of any third-party cookie providers for more information about how they use cookie information.
Advertising Tracking Technology and Analytics
GasBuddy uses third-party service providers to display advertising on our Services and serve advertising on other third-party sites that is more relevant to you or your interests. They are also used to limit the number of times you see an advertisement, and to help measure the effectiveness of our advertising. They may remember that you have visited a website and this information may be shared with other organizations, such as advertisers. This means that after you have used our Services, you may see advertisements about our Services elsewhere online.
We may also use tracking technologies to collect information about your use of our Services, including page view and "clickstream" data, the domain name of the service providing you with Internet access, device type, IP address, browser type and version, operating system and platform, the average time spent on our Site, webpages viewed, content searched for, clicks on the site, access times and other statistics, and assign unique identifiers to the device or other credentials you use to access the Sites for the same purposes.
Pages of our Sites and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).
Pages of our Sites may also use Java scripts, which are code snippets embedded in various parts of websites and applications that allow a variety of operations including improving the refresh speed of certain functionality or monitoring usage of various online components; entity tags, which are HTTP code mechanisms that allow portions of websites to be stored or "cached" within your browser to improve website performance; and HTML5 local storage, which allows data from websites to be stored or "cached" within your browser to store and retrieve data in HTML5 pages when the website is revisited.
With your permission, or if allowed by your device settings, we may use your device
Advertising ID to track your activity across this and other apps and websites. This is used to provide you with personalized and targeted advertising. You may reset your Advertising ID, or disable its sharing, using your device settings.Your Choices.
- First-Party Cookies. You can use your browser to enable, disable or delete first-party cookies. To do this, follow the instructions provided by your browser (usually located within the "Help", "Tools" or "Edit" settings). Please note, if you set your browser to disable cookies, you may not be able to access secure areas of the Site. Also, if you disable cookies, other parts of the Services may not work properly.
You can find more information about how to change your browser cookie settings at https://www.allaboutcookies.org. - Advertising Cookies. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target-audience preferences, you can opt-out of our interest-based targeting by using our Preference Centre.
You can also opt-out of interest-based targeting provided by participating ad servers through the Digital Advertising Alliance (https://optout.aboutads.info) or the Network Advertising Initiative (https://www.aboutads.info/choices). In addition, on your iPhone, iPad or Android mobile device, you can change your device settings to control whether you see online interest-based ads. - Mobile Advertising. You can opt out of having your mobile advertising identifiers used for certain types of advertising by accessing the settings in your mobile device and following the instructions. If you opt-out, we will overwrite your mobile advertising ID within the application and will not collect any further data relating to that ID for mobile advertising purposes. If you later decide to opt back in, we will be unable to continue and track you using the prior ID and you will for the purposes of this mobile advertising be a new user.
- Google Analytics. We may use Google Analytics on our Platform to help us understand how you use our Platform. You can learn about how to opt-out of Google Analytics here.
- Google Ads Manager. We use Google Ads to improve advertising, manage digital campaigns across the Service, and provide insights into user behavior. Google Ads Manager is a Google service, which may collect information including IP address, crash logs, performance data (such as app launch time), device IDs and advertising identifiers, and advertising data (e.g. ads viewed, ad impressions and clicks). - Facebook. We may use Facebook cookies or pixels to target ads to you. We also use Facebook Custom Audiences for marketing and behavioral targeting. Facebook Custom Audience links the activity on our sites and services with the Facebook advertising network. You can learn about how to opt-out of receiving targeted advertisements from Facebook here.
We do not control third parties’ collection or use of your information to serve interest-based advertising. However, you may limit all but essential tracking activity on the GasBuddy website by using the cookie consent management tool available on the website. Third parties may also provide you with ways to choose not to have your information collected or used in this way.
Please note that even if you opt-out of targeted advertising, you may still see advertising for GasBuddy on other sites, and advertising on the GasBuddy Service. However, this advertising will not be personalized or targeted to you.

Do Not Track. Some Internet browsers include the ability to transmit "Do Not Track" or "DNT" signals. Since uniform standards for DNT signals have not been adopted, the Services do not currently process or respond to DNT signals.
GasBuddy may use your Personal Information in the following ways:
- To provide access to the Service and to provide you with requested services and customer support and to process and respond to your inquiries;
- To personalize, customize, measure, and improve our services, content, and advertising and otherwise to enhance your experience;
- If you have turned on location sharing, to help you find gas stations and other services near to you;
- To prevent, detect, and investigate potentially prohibited or illegal activities, and enforce the GasBuddy Terms of Service;
- For fraud prevention and debt collection purposes;
- To analyze the accuracy, effectiveness, usability, or popularity of the Service;
- To generate and review reports and data about our user base and service usage patterns;
- To compile aggregate data for internal and external business purposes;
- To resolve disputes and troubleshoot problems;
- To contact you with information, including promotional, marketing and advertising information and recommendations that we believe may be of interest to you, including offers from third parties. These offers may be personalized based on the information we have about you, including your location if you have turned on location services;
- To provide you with other services requested by you as described when we collect the information;
- To provide you with information we deem relevant when you visit third-party merchant locations;
- To send push notifications to your mobile device to provide updates about the Service and other relevant messages, to the extent you consent to this during registration process; and
- As otherwise stated in this Privacy Policy or the GasBuddy Terms of Service.
We take care to allow your Personal Information to be accessed only by those who need access to perform their tasks and duties, and to share with other parties who have a legitimate purpose for accessing it. We want you to understand when and with whom we may share the information we collect. We may share information that we collect through the Services with third parties as follows:
- Our Service Providers. We may share your Personal Information with contractors or service providers who provide certain services to us or on our behalf, such as operating and supporting the Service, serving you with specialized offers or advertisements, or otherwise responding to your customer service requests. Our service providers may also help us prevent fraud and perform collections, as well as helping us carry out the other purposes we describe in this policy. These service providers will only have access to the information needed to perform these functions on our behalf and are required to provide your information with at least the same level of protection and security as we use for the Service.
- Our Business Customers. GasBuddy’s B2B Software-as-a-Service (SaaS), (collectively, the “Enterprise Services”), is designed to provide gas retailers a platform to maintain their station information, manage their brand, promote to their target consumer audience and measure success of their ads. By using our Enterprise Services, business customers can get access to information about the number of GasBuddy users who have visited their location, ratings, reviews and in-app behavioral information.
- Business Transfers or Bankruptcy. If GasBuddy becomes involved in a merger, acquisition, sale of assets, securities offering, bankruptcy, reorganization, dissolution, or other transaction or if the ownership of all or a part of our business otherwise changes, GasBuddy may share or transfer your Personal Information to a third party or parties in connection with the applicable transaction.
- Our Affiliates. We may share some or all of your Personal Information with our parent company, subsidiaries and corporate affiliates, joint ventures, or other companies under common control with us for internal business purposes as described in this Privacy Policy. We will require these entities to comply with the terms of this Privacy Policy with regard to the use of your information.
- Law Enforcement Authorities. To the extent permitted or required by law, we may share your Personal Information with law enforcement, governmental agencies, or authorized third parties, in response to a request relating to a criminal investigation or alleged illegal activity or any other activity that may expose us, you, or any other GasBuddy user to legal liability, or to protect our rights or property, or during emergencies when safety is at risk. Law enforcement requests may be sent to legal@gasbuddy.com.
- Business Partners. We may share with business partners the following information:
- Mobile Data: If you access the Service through a mobile device, we may share your device ID, mobile advertising ID, and geolocation information with a few carefully selected third-party business partners that may use this information on behalf of themselves or their third-party business partners to provide you with marketing information about products or services that may be of interest to you, and for purposes related to advertising, analytics, attribution (e.g., measuring ad performance) and research. We may also share information with our business partners in an aggregated manner that does not identify you, for example, by reporting the number of GasBuddy users that have visited a particular retail location over a period of time.
- Location Data: If you have agreed, we may share precise location information (data obtained from a device about the physical location of the device that is sufficiently precise to locate a specific individual or device). We may share your location information with Foursquare Labs, Inc. ("Foursquare") to provide customized engagement features, products, and content (including marketing/advertising content) to GasBuddy’s end users/customers, and to conduct internal analytics regarding GasBuddy’s end users/customers. Foursquare may also collect location data directly through the app. If you have location services enabled on your device for our mobile application, these third parties may provide your location to us and our service providers so we can provide you tailored offers and ads. Foursquare may also collect and use other information, such as your device type, advertising identifier on your device and device usage information (for example, a date/time stamp and your location when the App communicates with Foursquare). All such information is used by Foursquare for its own purposes in accordance with its privacy policy, as updated from time to time. You can opt-out of having your geo-location data shared with Foursquare through the “Settings” feature of the GasBuddy mobile application or through the settings on your device. We may provide social media features through the Service that enable you to share information with your social networks and to interact with the Service on various social media sites. Your use of these features may result in the collection or sharing of information about you by these sites, depending on the feature. We encourage you to review the privacy policies and settings on the social media sites you use to make sure you understand the information that may be collected, used, and shared by those sites. We are not responsible for the practices of such third party social media sites.
We may also offer links to other websites we do not control. These are intended for your information and convenience, and do not mean these websites are endorsed by GasBuddy. If you click on a link to a third-party site, you will be taken to a site we do not control. This includes, for example, links to surveys or reviews offered by participating merchants. GasBuddy is not responsible for the privacy practices of any third-parties other than as relevant to the Services and as described in this Privacy Policy.
You should read the privacy policy and terms of use for each website you visit.The "Tell a Friend" feature on the Sites allows you to send email notifications to your friends inviting them to use the Service. To use the "Tell a Friend" feature you will need to provide your friend's name and email address. For users in Canada, you may only use the "Tell a Friend" if you have your friend's express consent to provide that information to us. If you provide this information we will automatically send your friend an email asking them to visit the Sites and identifying you as the person who referred us to your friend.
GasBuddy takes reasonable measures, including physical, technological, and organizational security measures, to protect personal information against loss, theft and unauthorized use, disclosure, or modification. However, we cannot guarantee or warrant the security of any information and you provide personal information at your own risk. No internet or email transmission is ever fully secure or error-free. Email sent to or through the Service may not be secure. You should use caution whenever submitting information online and take special care in deciding what information you send to us via email. We are not responsible for circumvention of any privacy settings or security measures contained on the Site or Services.
You may identify, change, and update the Personal Information you provide through the Service, or change your preferences for how we use your Personal Information, as follows:
Accessing, Changing, Updating or Deleting Your Information. Unless it cannot be provided because we are required to protect other interests, you have the right to know what Personal Information we hold about you. You may make changes to the personal information you provided in connection with your GasBuddy account by logging in to your account and changing the applicable information. If you choose to close your account, we may still retain some of the information associated with your account for the purposes described in this Privacy Policy for a limited time. You may also request that we delete your account, and/or some of your Personal Information by contacting us at
help.gasbuddy.com. You may also delete your account by following the account deletion instructions within the GasBuddy app on Apple and Android devices, or by contacting us at
help.gasbuddy.com. If you delete your account in this manner you will have 48 hours to change your mind, after which your account will be deleted, and cannot be restored (though you may choose to create a new account if you choose). If you delete your account we may still retain some of your information for a limited time, for purposes such as legally required retention periods, and defending our rights, or those of third parties.
Following receipt of a request from you, we will take reasonable steps to update, correct or delete your information as required under the applicable law. Note that if you submit a request to delete your account, you may lose any benefits that you have accrued under your account. For more information on deleting your GasBuddy account, please review our
Terms of Service. Even if you request we delete your information, you should understand that we may keep information where permitted by law, including for the purposes described in Section 13 below.

GasBuddy is not intended for use by children under the age of sixteen (16). We will never knowingly collect Personal Information directly from children under 16 without verifiable parental consent. If you are under 16, please do not provide us with information of any kind whatsoever. We encourage parents and guardians to spend time with their children online and to be familiar with the websites they visit. If you have reason to believe that we may have accidentally received information from your child under the age of 16, please contact us immediately at
help.gasbuddy.com.
The Services are offered in Canada only and are intended solely for Canadian residents. Your Personal Information will be transferred, processed and stored in the United States, as well as other countries where we or our service providers have facilities. U.S. and other foreign privacy laws may not be as protective as those in your jurisdiction. Personal information processed and stored in another country may be subject to disclosure or access requests by the governments, courts or law enforcement or regulatory agencies in that country according to its laws. Your use of the Service represents your agreement to this. If you do not want your Personal Information transferred to or processed or stored in the United States, you should not use the Service.We retain Personal Information for active GasBuddy accounts as long as it is necessary and relevant for our operations. In addition, we may retain information from closed or deleted accounts to comply with the law, prevent fraud, resolve disputes, troubleshoot problems, assist with any investigation, enforce the GasBuddy Terms of Service and take other actions permitted by law.
Based on your jurisdiction of residence, you may have the rights listed below with respect to the personal information that we maintain about you. We may take steps to verify your identity, as permitted or required under applicable law, before we process your request. Verification may include asking you to provide information about yourself that we can match against information already in our possession. Your rights are subject to limitations set out in the law.
You may request access to your personal information that we hold and request a correction to it if you believe it is inaccurate, subject to exceptions in the applicable law. If you would like to have access to the personal information we have about you, or if you would like to have it corrected, please contact us using the contact information provided below. In some cases, we may not be able to allow you to access certain personal information in certain circumstances, for example, if it contains personal information of other persons, or for legal reasons.
Under certain circumstances and subject to applicable laws, you may also request additional information regarding our personal information governance practices, including details regarding what personal information is collected about you, the categories of persons who have access to your information, and how long your information will be retained. You may also request that we cease communicating your information, or de-index any hyperlink material attached to your name that provides access to your personal information by a technological means.
You may choose to restrict the collection or use of your personal information in the following ways:
- You may write to or email us using the contact information below to withdraw your consent to us using your personal information for direct marketing purposes.
- If you receive commercial email from us, you can also unsubscribe using the unsubscribe tool in such messages.
- You may exercise the opt-out tools we describe above, or contact us using the contact information below, if you would like to opt out of the sharing of your personal information through cross contextual marketing technology.
If you choose to withdraw consent from a processing of personal information we need to provide our Services, we may no longer be able to provide those Services to you.
